Drive4you Terms and Conditions
Version 1.0 — April 2026
Welcome to Drive4you. These Terms and Conditions apply between Drive4you (the platform), the renter and the rental owner. By creating an account, posting a listing or making a booking, you agree to the terms below. Please read them carefully — especially the rules about responsible use, damage, insurance and fines.
Articles 18 to 21 contain additional provisions for EU users (renters/owners with main residence in the EU/EEA), and Annex 1 contains the Fines Policy.
Article 1 — Definitions

| Listing | The offer of a specific Vehicle by an Owner. |
| Booking | A request from a Renter for a specific Rental Period. |
| Rental Agreement | The agreement that arises between Renter and Owner once a Booking is confirmed. |
| Rental Period | The period between check-in (handover of the Vehicle) and check-out (return of the Vehicle). |
| Booking Period | The period as recorded in the Booking. |
| Total Rental Amount | The total amount paid by the Renter: Rental Fee + Drive4you Service Fee + any surcharges. |
| Rental Fee | The amount due to the Owner for renting out the Vehicle. |
| Drive4you Service Fee | The fee charged by Drive4you for use of the Platform. |
| Deposit | The amount paid in advance by the Renter as security for damage or violations. |
| Excess | The amount the Renter bears in case of Damage when insurance applies. |
| Damage | All damage, defects and imperfections occurring to the Vehicle during the Rental Period. |
| Check-in / Check-out | The joint inspection and handover of the Vehicle, recorded through the Platform. |
| Fines Policy | The policy in Annex 1 listing violations and associated costs. |
| House Rules | Additional rules an Owner may set per Vehicle (e.g. smoking, pets). |
| Roadside Assistance | Help in case of breakdown, provided by the Owner or a third party. |
Article 2 — About Drive4you and the Service
2.1 Drive4you is an online platform that connects renters and owners of Vehicles in Morocco.
2.2 Drive4you is not a rental company and is not a party to the Rental Agreement between Renter and Owner. We facilitate:
- The placement and distribution of listings
- The search and booking process
- Payment processing through our payment partners
- Communication between parties
- Dispute mediation
- Documentation of check-in and check-out
2.3 Drive4you may amend these terms at any time. For significant changes you will be notified by email or in the app. By continuing to use the Platform after a change, you accept the amended terms.
2.4 Drive4you provides the Platform "as is". Drive4you cannot guarantee that the Platform is always available without interruptions or errors.
Article 3 — Account, registration and verification
3.1 To use the Platform you must register as a User and create a Profile. Only one Profile per person is permitted.
3.2 Requirements for Renters:
- At least 18 years old
- Holder of a valid category B driving licence for at least 12 months
- For luxury vehicles, SUVs and 4x4: at least 24 years old and licence held for at least 24 months
- Valid ID (passport or identity card) uploaded to the Profile
- Valid driving licence uploaded to the Profile
- No outstanding payments or blocked accounts with Drive4you
3.3 Requirements for Owners:
- Valid Moroccan ID or (for businesses) commercial registration number (RC) and tax number (ICE/IF)
- Vehicle is registered in the Owner's name OR the Owner can provide a written authorisation from the registered owner
- For leased cars: written consent from the leasing company
- For legal entities: valid authorisation of the duly empowered representative
3.4 Verification. Drive4you may check your identity, driving entitlement, payment history and any prior issues on the Platform. Drive4you may refuse or revoke verification without stating reasons.
3.5 Confidentiality of credentials. You are responsible for keeping your password confidential. If you suspect misuse, report it immediately to info@drive4you.app.
3.6 Suspension and removal. Drive4you may suspend or remove a Profile in the event of breach of these terms, complaints from other Users, non-payment, fraud or reasonable suspicion of misuse. Drive4you is not obliged to disclose the precise reason.
Article 4 — Vehicle requirements
4.1 Every Vehicle offered for rent must comply with:
- Valid Moroccan registration (carte grise) in the Owner's name
- Valid technical inspection (visite technique) — where applicable
- Valid third-party liability insurance (assurance responsabilité civile)
- Paid road tax (vignette) and other fiscal obligations
- Full regular maintenance per manufacturer specifications
- Sufficient fluids (engine oil, coolant, brake fluid)
- Mandatory equipment: warning triangle, safety vest, jack, spare wheel
- Free of defects affecting safety or usability
4.2 The Owner warrants that all information and photos in the Listing are current and correct. Photos must be updated at least quarterly or whenever there are changes.
4.3 Owners are required to clearly document existing damage in the listing and at every check-in. Anything not documented at check-in cannot be charged to the Renter at check-out.
4.4 A single Vehicle may only be offered through one Profile. Listing through multiple accounts is prohibited.
4.5 It is prohibited to rent a Vehicle to a family member (parents, siblings, children, partner) or housemate of the Owner.
4.6 Drive4you may remove a Vehicle from the Platform at any time if there is suspicion that it no longer meets the requirements.
Article 5 — Bookings and confirmation
5.1 A Booking becomes final once:
- The Owner accepts the Booking request through the Platform, AND
- The Service Fee has been paid online via Drive4you (the Rental Fee is paid by the Renter in cash to the Owner at pickup; any Deposit is arranged directly with the Owner — see article 7.4)
5.2 Requests not handled by the Owner within 24 hours, or whose pickup date has passed, are automatically cancelled.
5.3 A Renter can only rent one Vehicle for the same period through the Platform. When one Booking is approved, overlapping requests are automatically cancelled.
5.4 The maximum Rental Period is 90 consecutive days. For longer periods a new Booking must be placed.
5.5 The Rental Fee is set by the Owner. Drive4you may set minimum and maximum tariffs or provide dynamic pricing advice, but the Owner remains responsible for the final pricing.
Article 6 — Authorised drivers
6.1 Only the registered Renter who placed and verified the Booking may drive the Vehicle.
6.2 A second driver may be registered in advance through the Platform, provided that:
- Registration takes place before check-in
- A valid driving licence and ID of the second driver have been uploaded
- The second driver meets the same age and licence requirements as the Renter
- The Owner is automatically informed through the Platform
6.3 An unauthorised driver (an unregistered person behind the wheel) leads to:
- Full liability of the Renter for all damage and costs
- A fine in accordance with Annex 1 (Fines Policy)
- Possible exclusion from the Platform
- Possible loss of insurance cover
Article 7 — Payments
7.1 Payment methods. Under the current payment policy the Renter only pays the Drive4you Service Fee online, securely via Stripe (credit or debit card). The Renter pays the Rental Fee in cash to the Owner when picking up the Vehicle. Any Deposit is arranged directly with the Owner and is not processed by Drive4you (see article 7.4).
7.2 Stripe Services Agreement. For payments via Stripe you accept the Stripe Connected Account Agreement, including the Stripe Services Agreement (see stripe.com/connect-account/legal). By using the Platform you authorise Drive4you to share your data with Stripe for payment processing.
7.3 Online payment partner. The online payment of the Service Fee is currently processed exclusively via Stripe. Drive4you may add further payment methods later, which will then be shown in advance in the Platform.
7.4 Deposit. The Owner may require a Deposit for renting a Vehicle. This deposit is arranged directly between the Renter and the Owner when the Vehicle is picked up and is not collected, held or processed by Drive4you. Drive4you displays the deposit amount for information only. Arrangements about the amount, payment, return and any withholding of the deposit — for example in case of damage — are a matter between Renter and Owner. Drive4you is not a party to this and bears no liability for the deposit or any dispute about it.
7.5 Receipt of Rental Fee. Under the current payment policy the Owner receives the Rental Fee directly in cash from the Renter when the Vehicle is picked up. Drive4you does not collect or process this Rental Fee; Drive4you only receives the Service Fee paid online.
7.6 Additional charges. Drive4you may charge the following amounts to the Renter:
- Fines under the Fines Policy (Annex 1)
- Fuel costs when the Vehicle is returned with a lower level than agreed
- Cleaning costs in case of dirt
- Costs for late return or unapproved extension
- Traffic and parking fines incurred during the Rental Period + admin fee
- Excess in case of Damage
- Amounts advanced for breakdowns, towing, repairs
- VAT and other applicable taxes
7.7 Failed collection. In case of a failed or reversed payment Drive4you sends payment reminders. In case of persistent non-payment Drive4you may transfer the claim to a debt-collection agency, with additional costs in accordance with the WIK Act for EU customers or comparable Moroccan rules.
7.8 Set-off. Drive4you may set off amounts due against outstanding claims on the same User.
7.9 Taxes. Owners are themselves responsible for complying with tax obligations (income tax, VAT/TVA, etc.) on the Rental Fees received. Drive4you provides an annual overview on request.
Article 8 — Insurance and vehicle liability
8.1 No platform insurance. Drive4you does not offer its own insurance and is not an insurer or insurance intermediary. Any cover is a matter between Renter, Owner and their respective insurers.
8.2 Owner responsible for liability cover. The Owner warrants that the Vehicle is insured for at least third-party liability for the entire Rental Period, including rental to third parties. Some standard policies exclude rental — the Owner must verify this with their insurer.
8.3 Renter liability. Unless otherwise agreed in writing between Renter and Owner, the Renter is fully liable for:
- Damage to the Vehicle (above any insurance cover)
- Damage to third parties insofar as not covered by liability insurance
- Theft or loss of the Vehicle
- Loss of keys, registration or documents
8.4 Gross negligence. In case of gross negligence the Renter is always fully liable, without limitation. Gross negligence includes:
- Driving under the influence of alcohol, drugs or medication
- Driving without a valid licence
- Allowing an unauthorised driver
- Use in breach of these terms (see Article 9)
- Intentional damage
8.5 Police report mandatory. In case of any accident or damage incident the Renter must:
- Where appropriate, provide first aid and call the police in case of injury
- Have a police report (procès-verbal) drawn up
- Inform the Owner and Drive4you helpdesk through the Platform within 24 hours
- Upload photos and relevant evidence to the Platform
- Not have any repairs carried out without the Owner's or Drive4you's consent
8.6 Platform as evidence. The digital check-in/out reports, photos and chats on the Platform serve as evidence in disputes. Anything not documented through the Platform is hard to prove.
Article 9 — Prohibited use
It is prohibited to use the Vehicle for:
9.1 Driving lessons, races, competitions or test drives
9.2 Taxi services, ride-hailing (Uber, Careem, Heetch, etc.) or paid passenger transport
9.3 Subletting or onward renting to third parties
9.4 Transport of dangerous goods (explosives, flammables, drugs)
9.5 Off-road, desert driving or off paved roads, without the explicit written consent of the Owner and Drive4you
9.6 Leaving Morocco, without the prior written consent of the Owner and Drive4you
9.7 Heavy transport above the permitted weight or towing without consent
9.8 Use by a person who does not meet the requirements of Article 6
9.9 Use in breach of Moroccan traffic law or public order
Violation leads to immediate termination of the Rental Agreement, full liability for damage, and fines in accordance with Annex 1.
Article 10 — Cancellation and modification
10.1 Cancellation by the Renter
As long as the Service Fees have not yet been paid — and the Booking is therefore not yet confirmed — the Renter may cancel the Booking at any time free of charge. Once the Service Fees have been paid and the Booking is confirmed, the conditions below apply:

Drive4you Service Fees are not refunded, regardless of the cancellation timing.
10.2 Cancellation by the Owner

Cancellation by the Owner is in principle not allowed within 48 hours, save for force majeure. Drive4you assesses each case individually.
10.3 Modification
Modifications to the Booking (dates, location) are only possible with the consent of both parties through the Platform. Increasing the Rental Fee after confirmation is not allowed.
10.4 Extension
Extension during the Rental Period is possible if the Vehicle is available and the Owner agrees through the Platform. Without consent the Vehicle must be returned at the original time.
Article 11 — Check-in and check-out
11.1 Check-in procedure. At pickup the Vehicle is inspected together. Both parties record through the Platform:
- Mileage
- Fuel level (or charge level for EVs)
- Existing damage (photos required)
- Presence of equipment (keys, papers, jack, warning triangle, vest)
Both parties confirm through the Platform. Without confirmation the Vehicle may not be taken.
11.2 Right to refuse. The Owner may refuse handover when:
- The Renter cannot identify themselves with valid documents
- The Renter does not meet the age or licence requirements
- The Renter refuses to check in through the Platform
- There is reasonable ground to believe the Renter is unfit to drive (e.g. strong smell of alcohol, apparently under influence)
In that case the Owner may terminate the Rental Agreement at no cost.
11.3 The Renter may in turn decline to take the Vehicle if it does not match the Listing or Article 4. In that case the Renter is entitled to a full refund through Drive4you.
11.4 Check-out. The same inspection takes place at return. Both parties confirm through the Platform. Without check-out the Vehicle is recorded as "returned late" after 6 hours and the corresponding charges apply.
11.5 Disputes. Disagreements about damage or the state of the Vehicle must be reported to Drive4you through the Platform within 48 hours after check-out. Drive4you mediates based on the digital records.
Article 12 — Fuel and mileage
12.1 Fuel. The Vehicle is picked up and returned with the same fuel or charge level (full-to-full), unless agreed otherwise. For missing fuel the Owner charges the actual refuel cost plus a service fee in accordance with Annex 1.
12.2 Mileage limit. The mileage limit is set by the Owner per Vehicle and must be clearly stated in the Listing. The Renter must verify the limit before booking.
12.3 Above the limit, the per-kilometre surcharge stated in the Listing applies.
12.4 "Unlimited mileage" applies only when explicitly stated for the Vehicle.
Article 13 — Smoking, pets, cleanliness
13.1 Smoking. Smoking inside the Vehicle is not allowed, unless the Owner explicitly allows it in the House Rules.
13.2 Pets. Pets are only allowed with the Owner's prior consent and in a suitable carrier/crate. Without consent a fine applies in accordance with Annex 1.
13.3 Cleanliness. The Vehicle must be returned reasonably clean. Abnormal dirt (sand, mud, animal faeces, food residues, stains) leads to a cleaning fee.
13.4 Personal belongings. Drive4you and the Owner are not liable for personal belongings left in the Vehicle.
Article 14 — Late return
14.1 For late return an hourly surcharge applies (see Annex 1), capped at one additional daily rate per started day.
14.2 More than 24 hours late without prior notice may, after consultation with Drive4you, be reported by the Owner as theft.
14.3 During the overrun, insurance cover may lapse — any resulting damage is at the Renter's expense.
Article 15 — Reviews
15.1 After each completed Rental Agreement, Renter and Owner can review each other.
15.2 Reviews must be honest, respectful and based on facts.
15.3 Drive4you may remove reviews that:
- Are offensive, discriminatory or threatening
- Contain personal data of third parties
- Are demonstrably factually incorrect
- Are intended to harm competitors
15.4 Reviews cannot be changed after publication except via Drive4you support.
Article 16 — Privacy and data protection
16.1 Drive4you processes personal data in accordance with:
- Moroccan Law 09-08 on the protection of natural persons regarding the processing of personal data
- The General Data Protection Regulation (GDPR) for EU users
16.2 The full Privacy Policy is available on the Platform under /privacy. By registering you accept that Privacy Policy.
16.3 Drive4you retains personal data no longer than necessary for the purpose for which it was collected, taking into account statutory retention periods (e.g. tax: 10 years for Morocco).
16.4 You have the right to access, correct, delete and have your data ported via info@drive4you.app.
16.5 Identity and payment data are shared with our payment partners (Stripe) and, where relevant, authorities upon legal request.
Article 17 — Drive4you liability
17.1 Drive4you is not liable for:
- Damage, accidents or disputes between Renter and Owner
- The state of the Vehicle or the accuracy of the Listing
- Loss or injury during the Rental Period
- Traffic or parking violations during the Rental Period
- Damage caused by (temporary) unavailability of the Platform
- Insurer decisions about cover
- Indirect, consequential damage, loss of income or savings
17.2 Drive4you is liable for direct damage that is the direct result of an attributable failure by Drive4you, capped at EUR 1,000 (or MAD equivalent) per event and EUR 1,000 per calendar year.
17.3 The liability cap does not apply in case of intent or gross fault by Drive4you or its officers.
17.4 The User indemnifies Drive4you against third-party claims arising from the User's use of the Platform, a breach of these terms, or a breach of the Rental Agreement.
Article 18 — Intellectual property
18.1 The name "Drive4you", the logo, design, software, text and all other parts of the Platform are protected by intellectual property rights of Drive4you or its licensors.
18.2 Without prior written consent of Drive4you it is prohibited to:
- Copy or use the logo, brand name or design
- Scrape, copy or build a derivative platform
- Send automated requests (bots)
- Decompile or reverse-engineer the source code
18.3 By posting content (photos, descriptions, reviews) on the Platform you grant Drive4you a worldwide, royalty-free, non-exclusive, sub-licensable licence to use it for operation and marketing of the Platform.
Article 19 — Complaints and disputes
19.1 First step. Complaints must first be filed with Drive4you via info@drive4you.app or the helpdesk in the app. Drive4you aims to resolve within 14 days.
19.2 Objection to a fine. You can object to an imposed fine (see Annex 1) within 14 days via info@drive4you.app, with reasoning and evidence. Drive4you assesses the objection and may apply discretion.
19.3 No solution? If your complaint is not handled to your satisfaction:
- For Moroccan Users: Court of Casablanca
- For EU Consumers: you can also use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr
Article 20 — Additional provisions for EU Users
If you are a Consumer residing in the EU/EEA, the following additions apply on top of the above:
20.1 Right of withdrawal. The statutory right of withdrawal (14-day cooling-off) does not apply to car rental, as it concerns services delivered on a specific date (Article 16(l) of EU Directive 2011/83 / Article 6:230p Dutch Civil Code).
20.2 Languages. These terms are available in Dutch, English, French and Arabic. In case of interpretation differences the Dutch version prevails for EU users, and the Arabic version for Moroccan users.
20.3 Applicable law. For EU Consumers the Rome I Regulation applies: the Consumer retains the protection of the mandatory law of their country of habitual residence.
20.4 Dispute resolution. EU Consumers can also file complaints via the EU ODR platform (see Article 19.3).
Article 21 — Applicable law and competent court
21.1 These terms and any disputes arising from them are governed by Moroccan law.
21.2 The Court of Casablanca has exclusive jurisdiction, save for mandatory consumer law for EU users (Article 20.3).
21.3 If any provision of these terms is found to be void or unenforceable, the remaining provisions remain fully in force.
Article 22 — Miscellaneous
22.1 Drive4you may transfer its rights and obligations under these terms to a third party (e.g. in case of acquisition). Users will be informed in advance.
22.2 Failure by Drive4you to enforce a provision does not amount to a waiver of the right to do so later.

Annex 1 — Drive4you Fines Policy
The fines policy below is an integral part of the Terms and Conditions. By placing or accepting a Booking you agree to this policy.
A. Purpose and nature of fines
A.1 Fines are intended to cover costs incurred by Drive4you in case of violations and to prevent abuse.
A.2 Fines are imposed and collected by Drive4you. Unless explicitly stated otherwise, they do not accrue to the Owner.
A.3 Drive4you may, at its sole discretion, waive fines (in part). This does not create a precedent for future cases.
A.4 Amounts are indicative in MAD. For EU Consumers equivalent amounts in EUR apply.

D. Payment, collection and objection
D.1 Fines are charged to the Renter in accordance with the applicable payment policy (see article 7).
D.2 In case of failed collection, reminders follow. In case of persistent non-payment Drive4you may transfer the claim, with additional costs in accordance with Moroccan law or WIK for EU users.
D.3 A User may object to a fine within 14 days via info@drive4you.app, with evidence and reasoning. Drive4you assesses the objection within 14 business days.
D.4 Any set-off of fines or damage against the Deposit is a matter between Renter and Owner; Drive4you is not a party to this and does not process the Deposit (see article 7.4). Platform fines imposed by Drive4you may be set off by Drive4you against future payouts to the Owner.
